Marked Generation

TERMS AND CONDITIONS FOR PARTICIPATION “IN MARKED” INCLUDING PERMISSION, RELEASE, INDEMNIFICATION, AND HOLD HARMLESS AGREEMENT

 Definitions
Marked – Marked is a conference for youth who have lost one or both parents due to death. Marked is a 501(c)(3) non profit organization in accordance with all IRS regulations pertaining to 501(c)(3) entities. The Marked youth conference is a daylong conference with speakers and activities to help provide support for said youth.


Organizer(s) – Any owner, proprietor, operator, volunteer, organizer, manager, director, speaker, planner, coordinator, officer, employee, agent, or any other person involved with the organization, production, administration, or otherwise involved with the production of Marked.  

Parent(s) – A person having legal custody by reason of the fact that they are the parent or other having custody or legal guardianship by court order.

Participant(s) – Any minor or adult that is approved by Organizer to attend the conference and/or associated activities. Approval to attend need not be written and may be implied through participant’s/parent’s actions. Participants include Parents, visitors, or guests of any attendee.

General
In consideration of being permitted to participate in Marked in Utah on [August 1, 2015], Participant/Parent agrees to indemnify and hold harmless and blameless any and all Organizers and owners of the facilities from any and all liability from damages, loss, or injuries, either to person or property, which the participant may sustain while engaged in activity conducted by or in connection with Marked.

Participant/Parent understands and acknowledges that this hold harmless and indemnification agreement requires that Marked and its Organizers be indemnified from any losses or damages resulting from the acts or omissions from any guest, Participant, visitor, or other person attending Marked. This hold harmless and indemnification agreement shall also pertain to any claims due to Marked or its Organizers’ negligence.  Participant further agrees to release any claim that they may now have or have in the future against Marked and its Organizers relating to the use of any facilities, including claims due to Marked or its Organizers’ negligence.

Participant/Parent agrees to assume the full risk of any injuries, including death, or loss which the Participant/Parent may sustain as a result of participating in any and all activities connected with or associated with Marked.  Participant/Parent waives all claims of whatsoever kind or nature against Marked and its Organizers from any and all claims arising from injuries, including death, damage or loss which Participant/Parent may incur or may accrue to me or my minor child or ward on account of participation in the activities of this program.

Transportation and Arrival

Participant or if Participant is a minor, Participant’s Parent or legal guardian, is responsible to provide transportation to and from all events and activities. Participant or if Participant is a minor, Participant’s Parent or legal guardian, is responsible to notify Marked and its Organizers if Participant will arrive late. All minors must be checked-in and checked-out with Marked Organizers by a Parent or legal Guardian, or by someone designated, in writing, by the Parent or legal guardian. All Participants of majority age will check-in and check-out with Marked Organizers. Parent or legal guardian of Participants of minority age must notify Marked Organizers of any change in phone numbers, address, or people authorized to pick up said Participant.

 Injury and Illness

Participant/Parent will in case of injury or illness or other actions requiring Parental permission, grants to Organizers authority to act for them, in case the Parent cannot be reached. Participant/Parent understands that in case of injury, serious illness, or extreme cases of disciplinary action, an Organizer will, if need be, send home my son/daughter by the first available transportation at my own expense. Participant/Parent agrees to come to the facility where the conference is being held immediately when notified of any illness, injury, or disciplinary issue. Furthermore, Participant/Parent will not attend if they reason to believe that Participant is ill.

Emergency Policy

Any Participant/Parent must provide Parent(s) full name and emergency phone numbers, including cell phones, home phones, and any other number where he or she can be reached, day or night. Participant/Parent is responsible for insuring that any changes to this contact information is given to Marked Organizers. It is Marked and its Organizers’ policy to provide the following services in emergency situations: Immediately call to 911 emergency or other appropriate emergency numbers when Organizers reasonable believe necessary; Marked Organizers will make every effort to contact a Parent or emergency contact furnished to Marked.

In the event a Parent or emergency contact cannot be reached, Participant/Parent gives permission to the medical provider selected by an Organizer of majority age in charge to secure proper treatment, including hospitalization, anesthesia, surgery, or injections of medication for Participant. Medical providers are authorized to disclose to the Organizer in charge examination findings, test results, and treatment provided for purposes of medical evaluation of the participant, follow-up and communication with the Participant’s/Parent’s determination of the Participant’s ability to continue in Marked activities.

Dress Code

Clothing— Pants should not be excessively saggy; No underwear should be visible. Unacceptable clothing includes shorts or skirts that do not extend to the knee, tight clothing, shirts without sleeves, or other revealing attire; words on clothing must not be offensive or suggestive; appropriate footwear should be worn at all times; Hats are not to be worn indoors.

Age Requirements

Participant must be at least eight (8) years old. Special exceptions may be considered on a case by case basis. Although there is no maximum age, Marked is intended for youth, generally between the ages of eight (8) and eighteen 18, who have lost a parent.

Participation

Any Participant/Parent acknowledges that Participant is physically, emotionally, mentally, and otherwise able to participate in Marked and associated activities. Any Participant/Parent is responsible for Participant’s health. Marked does not carry insurance and any expense associated with any injury or illness will be the sole responsibility of any Participant/Parent or Participant’s/Parent’s insurance. Marked and its Organizers reserve the right to dismiss any Participant from Marked who may be harmful or a threat to the wellbeing of themselves, the other children or staff.


Allergies

In the event that any food or beverage is provided, Marked Organizers will make a reasonable attempt to identify ingredients that may cause allergic reactions for those with food allergies; however, Marked and its Organizers do not guaranty that any food or beverage will or will not contain any specific ingredient. Marked and its Organizers are not responsible for allergen-containing ingredients. Participants are hereby notified that there is always a risk of contamination. Any Participant/Parent concerned with food allergies needs to be aware of this risk. Marked and its Organizers will not assume any liability for adverse reactions to food or beverage consumed, or items one may come in contact with while eating food provided at Marked. Any food may have come in contact with all types of nuts, tree nuts, milk, soy, wheat, eggs, shellfish, or other potential food allergy.

Participants/Parents concerned with food allergies are encouraged to contact Marked Organizers for additional information.

By agreeing to the terms and conditions Participant/Parent understands that this agreement with the Marked Organization is conditioned on the compliance of Participant/Parent with the policies and guidelines of the program.

I have read and agree to comply with the program policies and procedures and have read and understand the above Waiver and Release of All Claims, understand the effect of the relinquishment, and agree to that effect.
